Kerry Meagher, Attorney and Certified Identity Theft Specialist will highlight the responsibilities, potential liabilities and solutions that employers must now address as a result of the rapid growth of workplace identity theft.
Key Points for Employers:
· Currently over 50% of all identity theft occurs in the workplace.
· As a result, federal legislation and the Federal Trade Commission (FTC) have outlined employer responsibilities and liabilities regarding data breaches.
· Several federal laws now require employers to implement an employee data security training and documentation program.
· The FTC has ruled that lack of a reasonable plan may be an unfair trade practice.
· Firewalls, encryption and other technology alone do not satisfy these federal requirements.
· Employers who fail to implement a data security program may be at risk of civil and criminal penalties.
Identity Theft Overview:
· The FBI reports that identity theft is America’s fastest-growing white collar crime.
· The U.S. Secret Service reports that global trafficking of financial data has surpassed that of drug trafficking.
· According to CIO Magazine, employer costs to resolve a data breach typically include losing 20% of their clients and spending between $40,000-$92,000 per victim to remediate the problem.
· Liability follows the data, so employers may be held responsible if their vendors experience a data breach that includes employer-supplied non-public information.
